Sale Items Terms and Conditions

Sale terms and conditions apply to the purchase of items marked on ‘sale’ or discounted and sold in The Consol Shop Woodmead or The Consol Shop Stellenbosch or The Consol Shop Cornubia in-store or online. By purchasing such sale items from these stores, you agree to these terms and conditions.


Product Availability and Condition

All sale items are subject to availability, while stocks last, within The Consol Shop Woodmead or The Consol Shop Stellenbosch or The Consol Shop Cornubia in-store or online.

No sale items will be transferred from one store to the other. All prices are displayed in South African Rands and valid at these stores only. 

We reserve the right to discontinue or change any sale specifications, at any time, without prior notice. 

All sale items are sold in the condition they are displayed in. The customer specifically accepts that no other warranty as to the condition of the sale items has been made and agrees that purchasing the sale items equals accepting the condition of the sale items as they are displayed. 

Sale items do not apply to pallets of these items.

Where an item has been used as a display, Consol reserves the right to mark it as a sale item, and no alternative item may be substituted.

Pricing

Sale prices charged are those reflected in store, inclusive of VAT. 

Prices indicated online may differ from prices indicated at the other online or physical stores, due to promotions, online or in-store specific specials.

All sale promotions may be subject to certain conditions, including stock availability, limited offer stipulations or order quantity limitations. 

The sale promotion applies only to items marked ‘sale’ or a similar word.

All items must be returned to specific Consol Shop where they were purchased.

The items must be returned with the original tax invoice/till slip.

The items must be returned in their original packaging.

All/any accessories must be returned at the same time and in the original packaging. 

Where an item has been purchased as a part of a bundle of multiple items, all multiple items within that bundle must be returned. 

No sale items may be returned if, after the purchase, they have been used, have been partially or entirely disassembled, physically altered, permanently installed, affixed, attached, joined, added to, blended, combined with, or embedded within, any other goods or property.

Any items for return must be treated with care and returned in the condition that they were purchased.

General

Sale prices are valid where specified on sales promotional elements.

Sale items cannot be reserved.

All sale items must be paid for before the customer takes them from the store.

No account or EFT payments are permitted, unless the customer is an existing customer of The Consol Shop Woodmead or The Consol Shop Stellenbosch or The Consol Shop Cornubia 

No new accounts will be created for new customers of the sale during this period.

Promotion, vouchers and special offers cannot be used in conjunction with any other promotion, special offers and vouchers.

Our Liability

Sale Terms & Conditions set out the full extent of our obligations and liabilities in respect of the sale items. 

To the extent permitted by law, no other warranties, conditions, or other terms are binding on The Consol Shop Woodmead or The Consol Shop Stellenbosch or The Consol Shop Cornubia in-store or online. 

In particular, but not limited to this, no warranty is made that the sale items are suitable for the purpose for which they are purchased, unless it can be shown that this purpose was communicated to us and acknowledged by us prior to the sale of the items. 

We shall not be liable whether in contract, delict or otherwise for any economic losses (including without limitation, loss of income, loss of profits, loss of contracts, business, or anticipated savings), loss of data, loss of goodwill or reputation or for any special, indirect, consequential, or punitive loss or damage of any kind howsoever arising, subject to the provisions of applicable law.

  1. All persons (“Participants”) entering the Plastic Free July–  Ardagh Glass Packaging  Competition “be one of two lucky people to win a Consol Glass hamper to the value of R500” Promotion (“Promotion”) agrees that the Promotion rules, as set out in these terms and conditions (“Terms and Conditions”), shall apply and are binding on them. 

 

  1. These Terms and Conditions override any advertising collateral and are the final agreement between the Promoters and the Participants

 

  1. Ardagh Glass Packaging and The Digital Media Collective are collectively referred to as the “Promoters” in respect of the Promotion for purposes of these Terms and Conditions.

 

  1. This Promotion is open to all persons of the age 18 years or older and resident in South Africa, excluding the directors, employees, shareholders, suppliers, and the immediate families of the Promoters, Promoters’ advertising and promotion agencies, associated companies, outlet owners and staff.
  2.  Competition Mechanics (How to enter):
  1. a) This Promotion commences 26 July 2024 and will run until 2 August 2024 and is subject to any early termination or extension thereof in the sole discretion of the Promoters, as contemplated in these Terms and Conditions.
  2. b) To enter the Promotion, the Participant must “follow Ardagh Glass Packaging on Instagram/ Facebook, like the competition post on social media, tag a friend in the comments section, as well as tell us which Plastic Free July challenge you took part in .”

 

  1. c) The  winners will be selected via an electronic random draw on 3 August 2024. The winners will be notified via social media on 4 August 2024 and their names published for public consumption, on social media on the 5th of August 2024. The winners hereby consent to their names being so published on social media. Should the winners not so consent, their entry will be automatically voided, and a new winner will be drawn as provided for in these rules.
  2. d) The Promoter’s decision is final, and no negotiations or correspondence will be entered into.

 

6) Prize:

  1. a) The winner will receive a Consol Shop hamper to the value of 500.
  2. b) The prize includes delivery.
  3. c) The prize cannot be exchanged for an alternative prize or cash.
  4. d) If the winner is unable, for whatever reason, to attend the night out they need to notify the promoters within a 72 hour notice period. 
  5. e) The winner must be over 18 years of age. 
  6. f) The Promoter reserves the right in their sole discretion, to replace the offer with one of equal or greater value, if this prize subsequently becomes unavailable.
  7. g) The winner of the competition to generate content in the form of images and their experience to be used and shared by Ardagh Glass Packaging on their social media platforms
  8. h) The winner of the competition to post images and content on their social media platforms to promote Ardagh Glass Packaging.
  9. i) Prize needs to be redeemed before 10 August 2024 and is also subject to availability of stock.

 

7) The Promoters will continuously monitor competition entries and Participant’s details. Any irregular behaviour, violation or attempted violation and/or suspicion of violation or irregular behaviour and/or non-compliance with these Terms and Conditions will result in immediate disqualification of the Participant.

 

8) Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations created for either the Participant or the Promoters in terms of the Consumer Protection Act, 68 of 2008 ("CPA"). 

 

9) The Participant acknowledges that he/she has been given an appropriate opportunity to first read these Terms and Conditions and that he/she understands and accepts these Terms and Conditions. A copy of these Terms and Conditions will be freely available at all sites where the competition takes place and from the Promoters.

 

10) All Participants participate entirely at their own risk. By reading and accepting these Terms and Conditions, the Participant gives consent to these risks and hereby indemnifies and holds harmless the Promoters, their directors, employees and agents, and all participating retailers of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Promotion and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Promoters.

 

11) The Promoters, their directors, employees, agents and distributors, and all participating retailers accept no responsibility and they will not, in any circumstances, be liable to compensate the Participant, or accept any liability for: (a) any inability by the Participant to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize.

 

12) The Participant agrees to hold the Promoters harmless for any claim made against the Promoters or their respective affiliates by third parties due to the Participant’s breach of these Terms and Conditions.

 

13) The Promoters reserve the right in their sole discretion, to terminate or extend the Promotion at any time and without notice, should a reasonable need to do so arise. In the event of such termination or extension, all Participants agree to waive (give up) any rights that they may have in terms of the Promotion and acknowledge that they will have no recourse against the Promoters, its advertising agencies, advisors, suppliers and nominated agents.

 

14) The Promoters reserve the right to vary these Terms and Conditions at any time during the Promotion Period should a reasonable need to do so arise, by posting such amended terms and conditions on The Consol Shop Website. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

 

15) Any Participant, in seeking to redeem and use the prize, agrees that they are bound by these Terms and Conditions.

 

16) The prizes will not be allocated if any of the entry procedures or any of these Terms and Conditions have not been adhered to.

 

17) The Promoters, their directors, employees, agents and distributors, are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person other than the Promoters themselves.

 

18) The Promoters, their directors, employees, agents and distributors, have no responsibility for the administration of the venue(s) in relation to the prizes and will not accept any liability in relation to the quality, performance or availability of goods and/or services at such venues or related to the prizes.

 

19) By entering this Promotion in accordance with its terms, Participants acknowledge that the Promotion will be managed in accordance with the provisions of the CPA. Qualifying Participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the prize to the Participant. Should any qualifying Participant refuse or be unable to comply with this requirement, the Participant shall be deemed to have rejected the prize and a new winner shall be selected as provided for in these Terms and Conditions.
